How to challenge a fine for violating SDA

A fine, for a traffic violation you have not committed, can and should be contested.
How to do this for dengi.ua lawyer, the head of criminal practice of UC "Riyako&partners" - Zinaida Chuprina told.

First, it should be noted that most fines orders are issued in grave violation of the law. This in turn gives grounds for appeal.

The most frequent violation, which may give rise to an appeal, is that the driver is not informed by a police officer of his rights and obligations.

In addition to this:

  • Inaccurate indication of the place where the offence was committed,
  • Hearing of the case at the place of origin (not the police headquarters),
  • The absence of evidence to prove the offender’s guilt and others are also grounds for appeal
