Law news How will the "Language Law" affect business and public authorities?

How will the

Law 2704-VIII, "On ensuring the functioning of the Ukrainian language as the State language", or as it was called by the people - the "Law on Language", entered into force on 16 July.

What will change in the life of a Ukrainian?

How will the Act affect business and public administration?

told for dengi.ua lawyer, managing partner of UC "Riyako & Partners" - Yevgeny Riyako
According to the lawyer, the first thing to remember is that the Law will be implemented in stages and will last for several years.

First of all, changes will start with business - all labor relations, communication with customers (consumers) should be exclusively in Ukrainian language. Of course, the possibility of parallel use of other languages at the will of the parties was not denied. However, Ukrainian according to the Law is mandatory and priority.

What would happen to someone who would not abide by the "Language Act"?

The "language violator" is subject to inspection and fines of up to 12,000 UAH.

As noted above, the Act will enter into force in stages, which means that the provisions defining Ukrainian as the only State language will enter into force first. The rest of the articles have a so-called delay. Also the whole business will feel the change at once. However, in the next 2-3 years the use of the Ukrainian language will become mandatory in all spheres of legal relations.

The key idea is the introduction of the Ukrainian language as the only State language in the whole territory of Ukraine - from the private to the public sphere of relations, business sphere. In addition to business relations, the Act makes the use of language mandatory in labour legal relations. Communication in the workplace must be in Ukrainian and the employer has no right to require employees to speak another language. And the employment contract between the employer and the employee - must be in Ukrainian, with possible translations into other languages.

In addition, all software and mobile applications that allow for the purchase of goods and services are required to have a full Russian version from 16 July.

The next stage will start on January 16, 2020 - Article 32, which obliges advertising to switch to Ukrainian (outdoor advertising, printed media, radio, television and the Internet.

However, according to counsel, this is not the correct approach, since only the market, not the State, can dictate the rules as to "sell" and, as a result, the rule will be violated from time to time.

What other features of this law are there?
How would the public feel about him?
Was it deemed unconstitutional?
